Agreement to Terms

These Terms of Service ("Terms") govern your use of Comfy and the services, features, content, and applications we offer (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

Eligibility

You must be at least 18 years old to use Comfy. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this agreement.

Account Registration

To use Comfy, you must create an account. When you register, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password and account
• Accept all responsibility for activity that occurs under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or illegal activity.

Use of the Service

Permitted Use

You may use Comfy for personal, non-commercial purposes to:

• Connect your bank accounts and view financial information
• Ask questions about your finances and receive AI-powered insights
• Track spending, bills, and balances
• Manage your financial safety buffer and affordability calculations

Prohibited Use

You agree NOT to:

• Use the Service for any illegal or fraudulent purpose
• Reverse engineer, decompile, or disassemble any portion of the Service
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated tools (bots, scrapers) to access the Service
• Upload viruses, malware, or other malicious code
• Harass, abuse, or harm other users or Comfy employees
• Impersonate another person or entity

Bank Connections via Plaid

Comfy uses Plaid to securely connect your bank accounts. By connecting your bank account:

• You authorize Comfy to access your financial data through Plaid
• You agree to Plaid's End User Privacy Policy and Terms of Service
• You understand that we only have read-only access and cannot move money
• You can disconnect your accounts at any time through Settings

We are not responsible for errors in data provided by Plaid or your financial institution. Always verify important information directly with your bank.

AI-Generated Financial Insights

Comfy uses artificial intelligence to provide financial insights and answer your questions. You acknowledge that:

• AI-generated insights are for informational purposes only and not financial advice
• We do not guarantee the accuracy, completeness, or timeliness of AI responses
• You should not rely solely on Comfy for major financial decisions
• Comfy is not a licensed financial advisor, accountant, or tax professional
• You are solely responsible for your financial decisions

Fees and Payments

Comfy is currently free to use. We reserve the right to introduce premium features or subscription plans in the future. If we do, we will notify you in advance and give you the option to opt in. You will never be charged without your explicit consent.

Intellectual Property

The Service and its original content (excluding user data), features, and functionality are owned by Comfy and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Your financial data belongs to you. By using the Service, you grant us a limited license to use your data solely to provide and improve the Service.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not warrant that results obtained from the Service will be accurate or reliable.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Unauthorized access to or alteration of your data
• Any conduct or content of third parties on the Service
• Financial decisions you make based on information from the Service

Indemnification

You agree to defend, indemnify, and hold harmless Comfy and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

Termination

You may terminate your account at any time by deleting it through the app settings. We may suspend or terminate your account if:

• You violate these Terms
• We suspect fraudulent, abusive, or illegal activity
• We discontinue the Service (with advance notice)

Upon termination, your right to use the Service will immediately cease. We will delete your data within 30 days of account deletion.

Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you via email or through the app. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
